By Travis Fain, tfain@dailypress. 1:08 p.m. EDT, April 18, 2014RICHMOND – Convicted drug dealers won't have to wait several years to get their voting rights back any more under reforms Gov. Terry McAuliffe announced Friday. McAuliffe also said he plans to shrink the waiting period for violent felons from five years to three – a clock that starts after they serve their time and pay any required restitution. McAuliffe will also roll out an extensive list of code cites early next week to make it clear who has to wait those three years who doesn't, his office said in a news release. Currently the state provides examples of crimes that do and don't require the waiting period, and the Secretary of the Commonwealth's office goes case-by-case to see whether applicants qualify. "Virginians who have made a mistake and paid their debt to society should have their voting rights restored through a process that is as transparent and responsive as possible," McAuliffe said in the release. The state constitution gives Virginia governors wide latitude when it comes to restoring voting rights. Virginia has been of the stricter states in the nation when it comes to restoration rules, but McAuliffe is following previous Gov. Bob McDonnell in loosening those rules. McDonnell ended a waiting period for non-violent felons last year, but his administration classified drug dealing as a violent crime for the purposes of rights restoration. Under the McAuliffe administration "basically all drug crimes" will be considered non-violent, spokesman Brian Coy said. Del. Robert B. Bell, who chairs the House of Delegates' subcommittee on the state's criminal code, said Friday that he'd like to see the administration's detailed list, but immediate restoration for drug dealers concerned him. "It's very disappointing," said Bell, R-Charlottesville. "The law already allowed people who use drugs to apply for immediate restoration. ... This would mean people who deal heroin, people who deal drugs to kids. "These are people who impose enormous harm ... and create the market for all the violence that comes," Bell said. McAuliffe said allowing people to vote is an important way to bring people back into society. "I want them back working," he said during a Friday afternoon radio interview. "I want them part of society. … Let's treat people with dignity and respect. Coy noted that this change focuses on voting rights – it has nothing to do with the restoration of the right to own a gun. Also, if a person convicted of a drug-related felony is also convicted of a violent crime, they'll have to wait three years for restoration, Coy said. Virginia's chapter of the American Civil Liberties Union applauded the governor's announcement Friday. It said more than 450,000 Virginians are unable to vote right now because of a felony conviction, and that many of those convictions were drug related. It's difficult to say how many of these people will come back on the state's voting rolls before this year's elections. Though the process is being streamlined, Coy said they will still have to apply to the Secretary of the Commonwealth's office to have their voting rights restored.
